Attention Independent Candidates – Funding & Disclosure Obligations

Nominations are open for those who would like to stand as a candidate or group of candidates for the 2018 State Election.

Candidates have obligations under the funding and disclosure scheme contained in Part 13A of the Electoral Act 1985.

A candidate’s funding and disclosure obligations commence when their ‘disclosure period’ commences.

Disclosure period commencement

  • For a group, their disclosure period commences on the day they lodge the section 58 application (to be grouped on the ballot papers).

     For a ‘new candidate’, the disclosure period commences on the earliest of either:

    • the day they announce their intention to stand as a candidate for the election, or 
    • the day they lodge their nomination form.

             A ‘new candidate’ is a person who:

    • has not previously been a candidate in for a House of Assembly election any time in the past five years before polling day, or
    • has not previously been a candidate for a Legislative Council election any time in the past nine years before polling day.
  • For a candidate who is not a ‘new candidate’, their disclosure period commences from 30 days after polling day of the last preceding election in which they were a candidate. However, because Part 13A only came into effect on 1 July 2015, the disclosure period for these candidates commenced on 1 July 2015.

Lodgement of returns

Candidates are required to lodge Campaign Donations Returns.

Many candidates have already started campaigning by displaying corflutes and distributing electoral material. If you have commenced campaigning, then you are required to commence lodgement of your Campaign Donations Returns. 

For those candidates who have not commenced campaigning, you will be required to start lodging your Campaign Donations Returns once you have lodged your nomination forms.
